HIGHLIGHTS OF 2004 HOMEOWNERS, CONDOMINIUM AND COOPERATIVE ASSOCIATION LEGISLATION

In its 2004 legislative session, the Florida legislature was very active with regard to community associations. Numerous Bills affecting condominium and homeowners associations were considered. The following summary discusses the enacted Bills concerning community associations. Copies of the legislation may be obtained by contacting the Florida Legislative Information Department at (800) 342-1827, by requesting the following Bills: SB 1184, SB 1728, SB 2984, and HB 1899. They can also be viewed on the Internet at http://www.leg.state.fl.us. SB 2984 duplicates many of the legislative changes in SB 1184. The 2004 legislative changes are discussed separately below for (1) homeowners associations, and (2) condominium and cooperative associations. An item concerning construction defect litigation relating to all community associations is noted at the end of this Memorandum.
